These Terms of Service ("Terms") form a binding agreement between you and MarketHub Africa Inc. ("MarketHub", "we", "us") and govern your access to and use of markethubafrica.com, our mobile applications, and related services (together, the "Service"). By creating an account or using the Service you accept these Terms in full. If you do not accept them, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By registering you confirm that you have the legal capacity to enter into these Terms and that the information you provide is accurate and current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@markethubafrica.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a risk to other users.
MarketHub is a venue connecting buyers and sellers. We are not a party to any transaction between users. We do not own, sell, or take possession of listed items, and we make no warranty as to the quality, safety, legality, or accuracy of listings. Sellers are solely responsible for the items they offer and for compliance with applicable laws (including consumer-protection, tax, and import/export laws).
You may not list, post, or transmit content that:
We may remove any listing or content at our discretion, and we cooperate with law enforcement where required.
Posting basic listings is free. Paid services (boost packages, featured slots) are charged per the prices shown at checkout. Buyer-seller payments are arranged directly between users; MarketHub does not currently process payments and is not responsible for disputes over off-platform transactions. We strongly recommend meeting in person, in a public place, and inspecting items before payment.
You agree to communicate honestly and respectfully. Harassment, hate speech, threats, spam, and the impersonation of other users are not permitted. We may moderate or remove messages and reviews that breach these Terms. Reports filed via the in-app reporting tools are reviewed by our team.
The Service, including its design, code, and trademarks, is owned by MarketHub Africa Inc. and protected by copyright, trademark, and other laws. You retain ownership of content you post but grant us a worldwide, royalty-free, sublicensable licence to host, display, and distribute that content for the purpose of operating and promoting the Service.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, MarketHub disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, MarketHub will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any direct damages will not exceed the amount you paid to us in the twelve months preceding the claim, or USD 100, whichever is greater.
You agree to indemnify and hold MarketHub harmless from any claim, loss, or demand (including legal fees) arising out of your use of the Service, your content, or your breach of these Terms.
You may close your account at any time from the dashboard. We may suspend or terminate your access if you breach these Terms or if continued access would harm other users or our systems. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.
These Terms are governed by the laws of the Republic of South Africa. Disputes arising out of or in connection with these Terms will be resolved by the competent courts of Johannesburg, South Africa, unless local mandatory law in your country provides otherwise.
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
